TERMS AND CONDITIONS

ISABIS WATCH PTY LTD ("ISABIS WATCH " "we" "us") website(s) (our "Site" or "Sites") and related services are made available to you in accordance with the following Terms of Use & Service, and any other rules posted on our Sites (collectively, the "TOS"). Please read the TOS carefully before placing any orders with us and on www.isabiswatches.com. We strongly recommend you keep a copy of the TOS for future reference. ISABIS WATCH is a trading name of ISABIS WATCH PTY LTD, a company registered in South Africa under registration number K2016462528. Our registered address is 35 MONKOR DRIVE, RANDPARK RIDGE 2194.

We may modify the Terms of Use and Service (TOS) from time to time. Please read the TOS and check back often. If you do not agree to any change to the TOS, then please refrain from using our website www.isabiswatches.com. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.

PRICES

Prices quoted on our website are the final price of product and packaging. The cost of postage and carriage is shown separately and will be specified on checkout. All published prices are subject to change at any time without notice.

IMPORT DUTIES AND ADDITIONAL FEES

If you are ordering from outside the RSA then you may be charged import duty or tax costs which we have no control over. We recommend you contact your local customs office to determine what additional charges may be applicable. These additional costs will be for your account regardless of any promotion advertised on www.isabiswatches.com or at any other time. If you are a customer whose credit/debit card is not denominated in global currency the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction. Please note that you do not need a PayPal or Payfast account to pay on our website and your currency will be converted in real time and charged to you in accordance with the exchange rate on the day you purchase your watch. Please note that if you have clicked through to checkout, then it is understood that you have read our Terms and Conditions & Privacy Policies. No refunds will be given nor will additional fees be paid by ISABIS WATCH PTY LTD on the basis of miscommunications or unread Terms &Conditions and Privacy Policies by customers.

PAYMENT

We accept Paypal, Visa, MasterCard, and Maestro and any other methods which may be clearly advertised on the Site from time to time. You can also choose to pay with PayPal or PayFast and do not need an account with either provider to pay. When selecting this option at checkout, you will be directed to the PayPal site to 'Log In' and review the amount shown before clicking 'Pay Now'. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to ISABIS WATCH, we will not be liable for any delay or non-delivery.

Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. Once payment has reflected in the ISABIS WATCH PTY LTD bank account, your order will be processed. Delivery times will depend on delivery methods chosen.

ORDER ACCEPTANCE

Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order, just a confirmation that we have received it. Unless you cancel your order, acceptance of your order and completion of the contract between you and ISABIS WATCH will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in Johannesburg, South Africa and the language of the contract is English.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorisation for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the TOS. We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We may also, limit or cancel quantities of products purchased per person, per household or per order. This will be enforced if we suspect a customer is trying to re sell or produce copies of our designs.

These restrictions may include orders placed by or under the same account, the same credit card, the same email address, or orders that use the same promotional code, billing or shipping address. In the event that we make a change or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. Additionally, we may limit or prohibit orders that, in our sole judgement, appears to be placed by dealers, resellers, distributors or any other unauthorised party. You are not permitted to resell any products or services purchased through the Site for commercial purposes. (please see wholesale & copywrite).

We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold, removing, screening or editing any materials or content on the Site, refusing to process a transaction or unwinding or suspending any transaction after processing has begun. Whilst every effort is made to make sure details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email or telephone you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we shall refund the full amount as soon as we are able. In the event that products are recalled in transit, we will process your refund once the products have been returned to us. Please note that not all of our designs will be repeated.

COUPON CODES
We offer promotional codes on
www.isabiswatches.com from time to time as well as on our Facebook and Instagram pages. The code will either reflect directly on our site or social pages to be entered in upon the check out process. At our discretion we may send you a unique code for your specific use which will be emailed to you. They will be allocated for a certain period of time and will no longer be available thereafter. When you click on links on www.isabiswatches.com, for example Instagram, Facebook etc, they may direct you away from our site. We are not responsible for the privacy policies or practices of other sites and encourage you to read their privacy terms and statements before accessing their site. Always read the terms and conditions of each website you are using.

We are not responsible for evaluating or examining the content or accuracy and will not have responsibility or liability for any third-party websites, materials, services or products of third parties.We are also not liable for any damages and harm related to the purchase or use of goods, resources, services, content, or any other transactions made in connection with any third-party websites. DELIVERY

We will give you an estimated delivery date for the Goods but no times or dates provided by us are guaranteed. We will arrange for packing and we will decide on the method of delivery either by post, courier or otherwise if your delivery is covered by us, otherwise this will spend on the delivery method you choose and we cannot be held liable for delays in postage. You must notify us promptly and in any event within 48 hours or receipt of any Goods if they appear to be damaged in transit. In those circumstances, you must also keep all packaging as this may be required when making a claim.

WARRANTY

We make no warranties, representations, statements or guarantees (whether express, implied in law or residual) regarding the site, the information contained on the site, your or your company's personal information or material and information transmitted over our system.

Your Watch holds a 1 year warranty on the movement of your watch. Your warranty does not cover your battery, mineral glass, plating or straps. If there is a manufacturing fault we will evaluate the watch.

FAULTY GOODS

Faulty goods are classified as faulty if they are received damaged or where a manufacturing fault occurs within six (6) months of purchase. Any items that are damaged as a result of wear and tear is not classed as a manufacturing fault. Please contact our Customer Relations team for further details.

RETURNS & REFUNDS

Whilst we hope you will love your ISABIS WATCH timepiece as much as we do, if your watch is unsuitable then you can return it for a refund. We accept unwanted returns on unworn watches up to 7 days after they are delivered as long as all the original packaging is retained and all protective packaging is intact.

Non-returnable items include gift cards and sale items
The cost of return must be covered by you, unless the item was received in a damaged or faulty state in which case we will reimburse you for the cost of return.
We reserve the right to accept or reject any returned item.
If you would like to return a watch we do request that you send an email to our customer relations team at hello@isabiswatches.com so that we can issue you with a returns authorisation number and send over all the relevant detail. Please refer to our returns policy for more details.

LATE RETURNS

Goods returned outside of the above timeframes will not be accepted and will be returned to the customer.

WHOLESALE AND COPYWRITE

If you would like to become a stockist of ISABIS watches, please contact us on admin@isabiswatches.com with your company name and website to discuss. Please note that all designs remain the sole property of ISABIS WATCH PTY LTD and are protected under copywriter and trademark laws. If any party is four to have copied or replicated our designs, legal action will be taken. If a Retailer is seen to be selling ISABIS watches for a price incongruent with the RSP agreed upon, ISABIS reserve the right to confiscate the stock and take legal action against the reseller.

RISK AND OWNERSHIP

The risk of loss or damage to Goods passes to you upon delivery. Ownership in all Goods remains with us until full payment of all amounts due to us have been received from you. You will be responsible for the safe custody and insurance of all Goods in your possession. You have no right to re-sell any Goods until payment has been received in full by us.

DISCLAIMER OF LIABILITY

We shall not be responsible for and disclaim all liability for any loss, liability, damage (whether direct, indirect or consequential), personal injury or expense of any nature whatsoever which may be suffered by you or any third party (including your company), as a result of or which may be attributable, directly or indirectly, to your access and use of the website, any information contained on the website, your or your company's personal information or material and information transmitted over our system. In particular, neither us nor any third party or data or content provider shall be liable in any way to you or to any other person, firm or corporation whatsoever for any loss, liability, damage (whether direct or consequential), personal injury or expense of any nature whatsoever arising from any delays, inaccuracies, errors in, or omission of any share price information or the transmission thereof, or for any actions taken in reliance thereon or occasioned thereby or by reason of non-performance or interruption, or termination thereof.

 

GOVERNING LAW

This website is offered, controlled and run from the Republic of South Africa, Accordingly, these terms and conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.

DISPUTES

Any dispute relating in any way to your visit to our website or the any products you purchase through our website that cannot be resolved directly between us will be referred to confidential arbitration in Johannesburg, South Africa. Such arbitration will be handled according to the rules then prevailing by the Arbitration Foundation of South Africa. The arbitrator’s award will be final and binding on the parties, save for manifest error and may be made an order of court by any court of competent jurisdiction.
